These Terms of Service (the "Terms") govern your access to and use of photoartify.com and the AI-powered image, video, audio, music, and related creation tools provided by PhotoArtify ("PhotoArtify," "we," "us," or "our"), collectively, the "Service."

By creating an account, purchasing credits or a subscription, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If the law where you live requires a higher age to enter into a binding agreement or consent to online services, you must meet that age requirement or have permission from a parent or legal guardian.

If you use the Service for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Accounts

You agree to provide accurate information, keep your account information current, and protect your login credentials. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security measures.

You must promptly notify us at [email protected] if you suspect unauthorized access. You may not sell, transfer, share, or make your account available to another person in a way that bypasses plan limits or creates a security risk.

3. The Service

PhotoArtify allows users to submit prompts and media, use third-party and proprietary AI workflows, and receive generated or transformed content. Features, supported models, output formats, generation times, credit costs, and availability may change.

We may impose reasonable limits to protect users, manage capacity, prevent abuse, or comply with law. We may add, modify, suspend, or discontinue features. Where practical, we will provide notice of material changes that significantly reduce paid functionality.

AI systems are probabilistic. Outputs may be inaccurate, incomplete, offensive, similar to content generated for others, or unsuitable for your intended purpose. You must review outputs before using or publishing them and must not rely on the Service for legal, medical, financial, safety-critical, or other high-risk decisions.

4. User Content

"User Content" means prompts, uploaded files, images, video, audio, text, feedback, and other material you submit to the Service. Between you and PhotoArtify, you retain any rights you have in your User Content.

You grant PhotoArtify a worldwide, non-exclusive, royalty-free license to host, copy, transmit, modify, display, and otherwise process User Content only as reasonably necessary to:

  • provide, maintain, secure, and improve the Service;
  • process generation requests through our service providers;
  • comply with law and enforce these Terms; and
  • display content you intentionally choose to publish or share.

You represent that you have all rights and permissions needed to submit User Content and authorize this processing. Do not upload confidential, regulated, or highly sensitive information unless you are authorized to do so and accept the applicable processing risks.

5. Generated Content

Subject to these Terms, applicable law, third-party model terms, and your payment plan, you may use generated content for personal or commercial purposes where the applicable plan expressly permits commercial use.

Because laws governing AI-generated content vary and continue to develop, PhotoArtify does not guarantee that generated content is eligible for copyright, trademark, patent, or other intellectual property protection. We also do not guarantee that an output is unique or that it will not resemble third-party content.

You are solely responsible for reviewing generated content and ensuring that your use does not violate law, these Terms, third-party rights, or the rules of any platform where you publish it. PhotoArtify does not provide legal clearance for generated content.

6. Acceptable Use

You may not use the Service to create, edit, upload, request, transform, store, publish, distribute, promote, or facilitate prohibited content or conduct. These rules apply to prompts, source files, reference media, generated outputs, account activity, and attempts to bypass moderation.

6.1 NSFW, Adult, and Sexual Content

The Service may not be used for NSFW or adult content, including:

  • pornography, explicit nudity, sexual acts, fetish content, erotic services, or content primarily intended for sexual arousal;
  • sexualized depictions of real or fictional people;
  • non-consensual intimate imagery, sexual deepfakes, voyeurism, or content created without the depicted person's permission;
  • sexual exploitation, coercion, trafficking, or content promoting sexual services; or
  • attempts to disguise prohibited sexual content through coded prompts, cropping, editing, or model-selection techniques.

6.2 Child Safety

The Service may not be used for any content that exploits, endangers, sexualizes, grooms, or abuses a minor or a person presented as a minor. This includes child sexual abuse material, suggestive depictions, age-regression sexualization, sexualized fictional minors, and instructions or communications that facilitate abuse.

Age-ambiguous sexual content is prohibited. We may report apparent child exploitation material and related account information to the appropriate authorities or child-safety organizations as required or permitted by law.

6.3 Fraud, Scams, and Deception

The Service may not be used to facilitate or promote:

  • scams, phishing, identity theft, payment fraud, investment fraud, romance fraud, impersonation, or social engineering;
  • forged or deceptive identity documents, financial documents, certificates, invoices, receipts, tickets, credentials, signatures, or currency;
  • misleading advertisements, fake endorsements, fabricated evidence, false reviews, or deceptive fundraising;
  • unauthorized deepfakes, voice clones, face swaps, or synthetic media intended to deceive others; or
  • spam, coordinated inauthentic behavior, account manipulation, or evasion of platform enforcement.

6.4 Crime and Illegal Activity

The Service may not be used to plan, instruct, promote, celebrate, conceal, or facilitate criminal or illegal activity, including:

  • theft, burglary, kidnapping, extortion, blackmail, stalking, evasion of law enforcement, or destruction of evidence;
  • human trafficking, exploitation, organized crime, terrorism, or violent extremism;
  • manufacture, acquisition, modification, or harmful use of weapons, explosives, incendiary devices, or hazardous materials;
  • production, trafficking, or illegal use of controlled substances;
  • cybercrime, malware, ransomware, credential theft, unauthorized access, denial-of-service attacks, or exploitation of security vulnerabilities; or
  • instructions that materially enable wrongdoing or help a person avoid detection or accountability.

The Service may not be used to generate, edit, promote, or distribute political or election-related content, including:

  • content involving political candidates, elected officials, political parties, campaigns, elections, referendums, or voting;
  • political advertising, lobbying, fundraising, advocacy, persuasion, propaganda, or targeted political messaging;
  • synthetic media, impersonation, or misleading depictions of political figures, government officials, or public institutions;
  • content intended to influence political opinions, civic participation, public-policy debates, or election outcomes; or
  • voter suppression, election interference, false voting information, or coordinated political manipulation.

This restriction applies regardless of political viewpoint, affiliation, country, or intended audience.

6.6 Violence, Abuse, and Dangerous Conduct

The Service may not be used for:

  • credible threats, incitement to violence, targeted abuse, harassment, bullying, stalking, or intimidation;
  • graphic gore, torture, cruelty, glorification of mass violence, or content celebrating real-world suffering;
  • instructions for dangerous challenges or activities likely to cause serious injury; or
  • content that encourages, instructs, or glorifies suicide, self-harm, or eating disorders.

Content intended to support prevention, recovery, or immediate safety may be reviewed differently, but it must not provide actionable harmful instructions.

6.7 Hate and Extremism

The Service may not be used to promote hatred, dehumanization, segregation, exclusion, or violence against people based on protected characteristics such as race, ethnicity, nationality, religion, caste, sex, gender, gender identity, sexual orientation, disability, or serious medical condition.

Recruitment, praise, propaganda, symbols, or operational support for terrorist, violent extremist, or organized hate groups is prohibited.

6.8 Privacy, Personal Data, and Surveillance

The Service may not be used to:

  • expose private or identifying information, including doxxing;
  • create or infer highly sensitive personal data without authorization;
  • perform unauthorized face recognition, biometric identification, tracking, or surveillance;
  • generate intimate, humiliating, or defamatory depictions of an identifiable person; or
  • violate another person's privacy, publicity, confidentiality, or data-protection rights.

6.9 Intellectual Property and Personality Rights

You may not upload or generate content that infringes copyrights, trademarks, patents, trade secrets, publicity rights, image rights, or other proprietary rights. You must have permission to use source material, brands, characters, logos, likenesses, voices, and other protected assets where permission is required.

6.10 Harmful Misinformation and Impersonation

The Service may not be used to create or distribute deceptive content that is reasonably likely to cause material harm, including fabricated emergencies, false public-safety information, fraudulent medical claims, manipulated evidence, or impersonation of a real person or organization.

Synthetic or edited media must not be presented as authentic when doing so could deceive, defraud, harass, or harm others.

6.11 Regulated and High-Risk Activities

The Service may not be used to facilitate illegal gambling, unlicensed financial services, market manipulation, predatory lending, unlawful sale of regulated goods, or automated high-impact decisions concerning employment, housing, education, insurance, credit, healthcare, or legal services without lawful authority and appropriate human review.

You may not present generated content as professional legal, medical, financial, or safety advice from a qualified professional.

6.12 Platform and Security Abuse

You may not:

  • bypass safety controls, content filters, rate limits, access restrictions, payment requirements, or technical protections;
  • reverse engineer, extract, copy, or attempt to obtain models, source code, system prompts, or non-public components of the Service except where applicable law expressly permits it;
  • introduce malicious code, interfere with the Service, overload infrastructure, or access systems or accounts without authorization;
  • use automated methods to scrape, harvest, or extract data from the Service without our written permission;
  • resell, sublicense, or provide unauthorized shared access to the Service; or
  • use multiple accounts, payment disputes, or other methods to evade restrictions, enforcement, or credit charges.

6.13 Enforcement

We may use automated systems and human review to detect or investigate suspected violations. We may refuse a request, block or remove content, restrict models or features, preserve relevant records, suspend or terminate accounts, and report conduct to service providers or authorities where appropriate.

Repeated, attempted, or severe violations may result in immediate termination. Used credits and amounts attributable to prohibited activity are not refundable except where required by law. You may contact [email protected] if you believe an enforcement action was made in error.

7. Intellectual Property

The Service, including its software, interface, branding, documentation, workflows, and underlying technology, is owned by PhotoArtify or its licensors and is protected by intellectual property and other laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

You may provide feedback or suggestions. You grant us a perpetual, worldwide, royalty-free right to use feedback without restriction or compensation, provided we do not publicly identify you as its source without permission.

8. Credits, Plans, and Payments

Prices, included credits, plan limits, credit validity, and billing intervals are shown at checkout or on the pricing page and form part of these Terms.

  • One-time credits: credits purchased as a one-time package expire on the date shown at purchase. Unless otherwise stated, current one-time packages are valid for one year.
  • Subscription credits: credits are issued according to the selected billing cycle and expire as described on the pricing page. Unless otherwise stated, monthly subscription credits do not roll over to a later billing cycle.
  • Credit usage: different models and operations may require different numbers of credits. The applicable cost is shown in the Service or determined by the selected generation settings.
  • Refund value: paid credits may be eligible for a usage-based refund under the Refund Policy. Credits returned to an original paid balance after a failed task retain their connection to that purchase. Free, bonus, promotional, referral, standalone service-recovery, or goodwill credits have no cash value.
  • Taxes and fees: prices may exclude taxes, duties, or payment-provider charges. You are responsible for amounts that apply to your purchase, except taxes imposed on our income.

Payments are processed by third-party payment providers. You authorize us and the applicable provider to charge the payment method you select for all amounts due, including recurring charges and applicable taxes.

9. Subscriptions and Cancellation

Paid subscriptions automatically renew for the billing interval shown at checkout unless canceled before the renewal date. Renewal charges may use the same payment method and then-current price, subject to any notice required by law.

The first monthly subscription payment includes a 3-calendar-day trial refund window, and the first annual subscription payment includes a 7-calendar-day trial refund window. Payment is collected at checkout and credits are provided after payment confirmation. These are refund-based trial windows, not delayed-billing trials.

During the applicable trial refund window, the first subscription payment is eligible for a full refund only if no subscription credits or paid features have been used. After any usage or after the applicable window, eligible refunds are calculated from the unused paid credits associated with that billing period. Renewal payments do not receive a new full-refund trial window.

You may cancel future renewals through your billing settings or the payment provider's management page. Cancellation normally takes effect at the end of the current paid billing period, and you generally retain access until that date. Canceling a subscription does not automatically create a refund for the current period.

We may change subscription prices or plan features. We will provide advance notice of material price changes where required, and the new price will apply to a later renewal rather than a charge already completed.

10. Refunds

Purchases and subscriptions are subject to our Refund Policy, which is incorporated into these Terms. One-time credit packages and subscription payments may qualify for a usage-based refund calculated from eligible unused paid credits. Used credits and free, bonus, promotional, referral, standalone service-recovery, or goodwill credits are not refundable and have no cash value. Credits returned to an original paid balance after a failed task may remain eligible under the Refund Policy.

If a generation fails because of a confirmed Service or provider error, the credits charged for that failed task may be automatically restored. A credit restoration is not the same as a cash refund.

11. Third-Party Services

The Service may rely on or link to third-party AI models, payment processors, identity providers, storage providers, analytics services, and other platforms. Your use of third-party services may be subject to their terms and policies. We are not responsible for third-party services or for changes, outages, content, or actions outside our reasonable control.

12. Suspension and Termination

You may stop using the Service at any time. You may request account deletion through available account settings or by contacting support.

We may suspend or terminate access if we reasonably believe that you violated these Terms, created risk or legal exposure, failed to pay amounts due, abused refunds or chargebacks, or used the Service in a way that may harm users, PhotoArtify, or third parties. Where appropriate, we may provide notice and an opportunity to appeal.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including sections concerning ownership, payments already due, disclaimers, limitations of liability, indemnity, disputes, and general terms.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." PhotoArtify disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

We do not warrant that generated content will be accurate, unique, lawful, non-infringing, or suitable for any particular use. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, PhotoArtify and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the Service.

To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of:

  1. the amount you paid to PhotoArtify for the Service during the 12 months before the event giving rise to the claim; or
  2. USD $100.

These limitations do not apply where liability cannot be limited or excluded under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PhotoArtify and its affiliates, officers, employees, agents, licensors, and service providers from claims, damages, losses, liabilities, and reasonable legal fees arising from your User Content, your use of generated content, your violation of these Terms, or your violation of another person's rights.

This section does not apply to the extent a claim results from PhotoArtify's own unlawful conduct, and it may not apply to consumers in jurisdictions where such obligations are restricted.

16. Governing Law and Disputes

These Terms are governed by the laws applicable to the PhotoArtify operator identified in our business or payment records, without regard to conflict-of-law rules. Courts with jurisdiction over that operator will have non-exclusive jurisdiction over disputes, unless applicable consumer law gives you the right to bring a claim in another court or forum.

Before filing a formal claim, you agree to contact [email protected] and attempt to resolve the dispute informally for at least 30 days. This requirement does not prevent either party from seeking urgent injunctive relief or using a small-claims process where available.

Nothing in these Terms limits mandatory consumer protections or statutory dispute rights available in your country or state.

17. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the "Last Updated" date. If a change materially affects your rights or an active paid subscription, we will provide additional notice where required by law.

Changes apply prospectively from their effective date. By continuing to use the Service after updated Terms take effect, you agree to the updated Terms.

18. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets.

These Terms, the Privacy Policy, the Refund Policy, and any plan-specific terms presented at purchase constitute the agreement between you and PhotoArtify regarding the Service.
